The Navey Law Firm is excited to share some recent results obtained for clients.
This week Nathaniel Navey argued a contested sentencing hearing in Kendall County for a client who plead guilty to a felony possession of controlled substance case. Initially the client was facing 15 years to life in prison with no possibility for probation on possession of a controlled substance with intent to deliver. However, the firm was successful in convincing the prosecutor to drop the distribution enhancement as the evidence was insufficient. At sentencing for the possession, the client still faced up to life in prison due to a prior prison trip. After meticulous preparation, the client’s history of enduring severe abuse throughout her life along with many documented mental health issues were presented to the court. Though the prosecution asked for prison, the Judge mercifully granted the client deferred adjudication and ordered the client to treatment. The client, who was once facing a minimum of 15 years incarceration, now has the chance to avoid prison and a felony conviction altogether.
For another client, the police will be closing out a case and not pursuing criminal charges regarding a heinous and false allegation of sexual abuse. In such instances, it is paramount to seek immediate representation by an attorney as soon as such an allegation has been made, and not wait until formal charges are pending as such allegations have the potential to ruin someone’s life. With the firm’s assistance, the client complied with the investigations into the matter. CPS ruled out any sexual abuse and the San Antonio Police Department closed out their investigation into this matter without pursuing charges. A huge relief for an innocent person.
