Whenever there’s a news story about a recent crime, there are inevitably a few comments saying something like
"And of course, he’ll lawyer up and get away with it."
"Watch, his attorney will find some loophole and he’ll walk free."

As a criminal defense attorney, I’ve been asked countless times how I can defend people who’ve committed such terrible acts.

I understand where the frustration comes from. To many people, when a defendant walks not because they’re innocent but because of how the case was handled (ex. a bad search, a coerced confession) it feels like they escaped through a loophole.

But it's important to understand that those so-called loopholes are not bugs in the system; they are the very safeguards that protect all of us. The Constitution guarantees due process and equal protection, meaning the government must follow fair procedures, and those procedures apply to everyone, whether you are rich or poor, guilty or innocent.

And even if you can’t afford an attorney, the government must provide one. That is the only thing the Constitution explicitly says the state has to pay for on your behalf. Not food. Not shelter. Not even healthcare. But a defense lawyer? That shows how essential this right is to a free society.

So is it frustrating when someone walks on what looks like a technicality? Of course. But the alternative of letting the government cut corners or violate our civil rights is far more dangerous. If we abandon those rules for the people we don’t like, it won’t be long before they’re gone for the rest of us too.

Have some of my clients done wrong? Absolutely. But they still have rights. They still deserve a defense. That is not a loophole. That is the law.

And don’t forget, many of my clients are, in fact, innocent. Without these protections, they would never have a chance.

Most people don’t want to take a traffic ticket to trial. Why spend thousands just to fight a $70 fine?

But one of our clients insisted she was in the right, even though, to be honest, we had doubts. She had made a left turn at an intersection and was T-boned by a car going straight. Usually, that’s an automatic loss. Left-turning drivers are expected to yield. We told her that, but she still wanted her day in court.

Attorney Jackie Ball took this one to trial and built the argument around Utah Code § 41-6a-903, which permits a left turn if there is no “immediate hazard.” Unfortunately, if there's an accident and no other witnesses, it's always assumed that the driver going straight had the right-of-way.

But Jackie got the other driver to admit she sped up when the light turned yellow and couldn’t say for sure whether she entered the intersection on a yellow or red. The officer confirmed he didn’t know the color of the light either.

Jackie took it from there and won.

This case was a reminder that a strong cross-examination can change the outcome, even when the odds look bad on paper.

Right when the pandemic started, we took on a case for a woman who slipped on black ice and broke her ankle. She ended up needing two surgeries. It wasn’t an easy case on liability, so we tried our best to settle it early without filing a lawsuit.

We got no offer for over a year.

So we finally filed suit against two defendants: the building owner and a transportation company that ran airport shuttles. Our argument was that the building owner should have cleared the walkway to the van, and the transport company should have parked under the covered entrance where there was no ice.

Three years later—after 9 depositions, multiple rounds of discovery, and 7 legal challenges where the judge ruled in our favor every single time—both defendants finally called it quits and agreed to a substantial settlement.

I’d bet they wish they had just settled with us back when the pandemic started.

Two friends went to a party. They were both underage, but neither had anything to drink. Within five minutes, the police showed up and handed out 59 citations for Minor in Possession. Both friends refused the breath test, which they had every right to do.

One of them came to our firm right away. We got his case dismissed in just three days.

The other decided to wait. Six months later, his case was still unresolved, and he had already been ordered to complete an alcohol education program.

Eventually, he hired us too. We got his case dismissed.

I just got into an accident. What should I do?

If you just got into a car accident, here’s what you need to do:

First, check for injuries on yourself and everyone else who is in the same vehicle. If you're facing traffic, pull over to the side of the road to prevent further accidents.

Second, if you’re injured even if it’s minor, call 911 immediately. If your cars are blocking traffic, call 911. If it’s a fender bender and no one is injured, you can call it in as a non-emergency. It’s still good to have it documented and that a police report is filed.

Third, gather evidence like names, addresses, and phone numbers of passengers, witnesses, and drivers—take photos of their IDs and insurance cards. Take photos of the accident and the damaged property.

Fourth, cooperate with the personnel dispatched to the scene, and never assume it’s your fault. Let the officers and insurance companies investigate.

Fifth, file an insurance claim. If you do not want to do this on your own, you may call a personal injury attorney to help you.

Sixth, even if you do not have injuries that must be addressed immediately, seek medical attention at your doctor’s office, E.R., or urgent care clinic. If you have auto insurance in Utah, you have up to $3,000 that can be used even if you are at fault.
