I don't often write about trials on this page, so this is the exception. I spent the last several days trying a case to a jury in Chelsea with my client charged with possession with intent to distribute ma*****na although he had a medical ma*****na card. But I wanted to share 2 points. First, it was amazing to me how little the police who arrested my client and a 25 year state police veteran "drug expert" knew about the law and theuse of medical ma*****na. It was agreat that a jury found my client not guilty, but my point 2 is not that...it is that after the not guilty I was able to get the judge to order the return of the 4 ounces of ma*****na because of the jury's finding that it was not contraband, and walk out of the courthouse with 4 ounces of ma*****na that I could then gift to a number of willing recipients. That was delightful first for me!!@!

If you took the breatalyzer and failed it, now is the time to move your case to trial quickly.

A Massachusetts District Court has ruled that no Breathalyzer tests administered in the state can be used as evidence in most court cases until the Office of Alcohol Testing proves its results are accurate.

California has a bill in the legislature that would make it a felony for prosecutors to withold evidence!! If passed this would be a first in the nation, and seems to me like a very good idea to make it clear that it is not just a professional responsibility, but a crime to withold evidence. A strong statement!!! I will watch this.

Really nice new case from the S.J.C. regarding impounding and towing of cars. The holding provides for four basis for impounding and towing and makes clear if there are practical alternatives to towing these should be considered before causing the expense and hassle to the owner of towing. Governor Baker has signed legislation removing the loss of license for convictions of crimes!!! This is a real step forward so that folks convicted of crimes can still work, get to medical appointments, and take care of their kids. Great article derived from A.C.L.U. records that New York Police have illegally obtained cell phone tracking information more than 1,000 times in the last five or so years, without warrants or notice of any kind using cell phone technology.
