“Saving the Deal” - Episode 5

In our fifth episode of “Saving the Deal,” Melanie shares how a new survey revealed an easement that threatened the buyer’s future use of the property.

THE PROBLEM: Melanie was representing a buyer in the purchase of some acreage along Main Street in Salado. The old survey they received at the time of their offer had no issues, but the contract called for a new survey due to its age. When the new survey came back, a 20-foot easement was revealed. Since the buyer was purchasing the land with the intention of using it for commercial purposes, including several buildings, a parking lot, and a driveway, this was an issue. With a large easement prohibiting the buyer’s plans, they would be purchasing a site they couldn’t use as intended.

THE SAVE: Melanie insisted the easement be addressed prior to closing. She worked at length with the buyer, buyer’s attorney, surveyor, underwriter, listing agent, and title company to make sure the property was insurable and the buyer could use the property as planned.
