๐ŸŽฅ Video #5 in Our Series: Top 10 Florida Probate Issues

Florida has some of the most complex homestead laws in the country โ€” and they play a major role in probate.

๐Ÿ’ This time, weโ€™re focusing on surviving spouses and Florida homestead law.

โš–๏ธ Under Florida public policy, homestead protections exist to prevent widows, minor children, and families from being left without a home after a loved one passes away.

โ— But the rules are highly technical.

The decisions a surviving spouse must make are often both emotionally and financially difficult.

โ–ถ๏ธ In this video (Top 10 Probate Issues #5), I explain:

โžก๏ธ What โ€œhomesteadโ€ really means in Florida probate

โžก๏ธ The automatic rights a surviving spouse has to remain in the home

โžก๏ธ Why homestead does not eliminate mortgages or ongoing expenses

โžก๏ธ How taxes, insurance, and upkeep affect whether keeping the home makes sense

โžก๏ธ When converting homestead into tenants-in-common with heirs may be necessary

โžก๏ธ How stepchildren and blended families complicate homestead decisions

โžก๏ธ When selling the property may actually be the smarter option

โžก๏ธ How minor childrenโ€™s rights are tied to Florida homestead protections

๐Ÿ‘‰๐Ÿป If youโ€™re dealing with a Florida probate involving a surviving spouse, homestead issues, or blended families, this breakdown will help you understand your options before making major decisions.

This is Video #4 in our Top 10 Probate Issues in Florida series.

๐Ÿ’ป One of the fastest-growing problems in Florida probate today is digital access.

โ— Mostly because people still donโ€™t understand the limits, rules, and complications of the digital world.

โšฐ๏ธ In the past, families could gather:
โ€” Bank statements
โ€” Investment records
โ€” Physical mail

to understand what assets a loved one left behind.

๐Ÿ”€ Today, itโ€™s far more complicated.

๐Ÿ”’ Nearly everything is locked behind:
โ€” Passwords
โ€” Two-factor authentication
โ€” Online-only accounts
โ€” Digital wallets
โ€” Cloud storage

โ–ถ๏ธ In this video, Matthew Weidner breaks down:

๐Ÿ‘‰๐Ÿป How to identify a decedentโ€™s assets when everything is digital

๐Ÿ‘‰๐Ÿป Why accessing Apple, Google, and other major platforms has become extremely difficult

๐Ÿ‘‰๐Ÿป What Florida families must prepare before a loved one passes away

๐Ÿ‘‰๐Ÿป How lost passwords can lead to permanently lost assets

๐Ÿ‘‰๐Ÿป Why crypto, online banking, cloud accounts, and even social media can create probate disasters

โš ๏ธ If youโ€™re handling a Florida estate โ€” or want to avoid a future probate nightmare โ€” this is a video you shouldnโ€™t skip.

๐ŸŽฅ This is Video #3 in the Top 10 Probate Issues in Florida series.

โ“ A question almost everyone asks before taking things to courtโ€ฆ

๐Ÿค” โ€œCan you avoid probate?โ€

๐Ÿ‘‰๐Ÿป The answer is YES.

But only if the work is done before someone passes away.

๐Ÿ›ก๏ธ You avoid probate when major assets are properly set up on the front end:

๐Ÿ‘‰๐Ÿป Jointly titled real estate
๐Ÿ‘‰๐Ÿป Life estate deeds or Lady Bird Deeds
๐Ÿ‘‰๐Ÿป Correct beneficiary designations
๐Ÿ‘‰๐Ÿป Bank accounts with POD / TOD
๐Ÿ‘‰๐Ÿป Investment accounts with named beneficiaries
๐Ÿ‘‰๐Ÿป Trusts that are properly funded

Most probate cases happen because something was left unfinished.

โ— A deed was never updated
โ— A bank account had no beneficiary
โ— A trust was created โ€” but no assets were ever transferred into it

๐Ÿ“ Estate planning only works when assets are transferred correctly.

โ€ผ๏ธ A beautiful binder or a calligraphy trust means nothing if the deeds and accounts donโ€™t match the plan.

So, to answer the question again โ€” yes, probate can be avoided.

๐Ÿ“ƒ But it requires proper planning, accurate paperwork, and usually guidance from an experienced estate planning attorney before anyone passes away.

โ“ Today we answer one of the most important questions in probate โ€” and one that truly matters:

๐Ÿค” โ€œHow much is this probate going to cost?โ€

๐Ÿ‘‰๐Ÿป The truth is simple:
You, the client, play a major role in how expensive a probate case becomes.

โš–๏ธ Florida Statute 733.6171 refers to โ€œreasonable fees.โ€
The problem? Those numbers are decades old and donโ€™t reflect modern probate realities.

๐Ÿ’ต The real cost depends on:

โ†’ The size of the estate
โ†’ How organised you are
โ†’ How quickly you respond
โ†’ Whether anyone is fighting

๐Ÿ’ต Small estates may only cost a few thousand dollars.

๐Ÿ’ฐ Large estates โ€” especially disputed ones โ€” can run into the tens of thousands.

โ€ผ๏ธ Where probate costs explode:

โš ๏ธ Miscommunication between heirs
โš ๏ธ Beneficiaries fighting
โš ๏ธ Missing documents
โš ๏ธ Slow responses

๐Ÿข To keep probate costs low and cases moving efficiently, our office uses:

๐Ÿ‘‰๐Ÿป Electronic signing
๐Ÿ‘‰๐Ÿป Faster document tools
๐Ÿ‘‰๐Ÿป Clear checklists to control costs

โ€ผ๏ธ Probate becomes expensive when emotions take over and family members start fighting โ€” often over items or decisions that donโ€™t change the final outcome.

โ–ถ๏ธ This video explains what drives probate fees
and how to keep your probate as affordable as possible.

๐ŸŽฅ Video #1 in Our New Series

โ–ถ๏ธ Top 10 Probate Issues in Florida

โ“ One of the most common questions we hear from clients:

๐Ÿค” โ€œHow long does probate take in Florida?โ€

๐Ÿ”บ The honest answer?

It depends.

Primarily on:
โ€” You
โ€” The client
โ€” Preparation

๐Ÿ“„ When documents are organised and proper estate planning is already in place, the case can move smoothlyโ€”almost like clockwork.

โ— But hereโ€™s the reality:

Itโ€™s rarely that simple.

Most probate cases involve:
โ€” Missing or incomplete documents
โ€” Unanswered questions
โ€” Difficult family conversations
โ€” Unexpected legal hurdles

All of this takes time.

โ€ผ๏ธ And the biggest delay of all?

โณ The mandatory 3-month creditor period.

โš–๏ธ Under Florida law, creditors must be notified and given time to file claims.
Those claims must then be reviewed, resolved, or formally disputed before probate can move forward.

๐Ÿ‘‰ So how can you help speed things up?

๐Ÿ“ Sign required documents as early as possible

โฌ†๏ธ Upload requested information promptly

๐Ÿคต๐Ÿปโ€โ™‚๏ธ Respond quickly to your attorneyโ€™s requests

๐Ÿ›œ Use electronic signatures whenever available

๐Ÿ‘จ๐Ÿปโ€โš–๏ธ Many Florida judges are now strictly enforcing statutory deadlinesโ€”and attorneys are being held accountable in court.

๐Ÿข Our office respects that.
We push every case forward efficiently, out of respect for both our clients and the courts.

โ–ถ๏ธ This video breaks down everything you need to know
about probate timelines, delays, and how to keep your case moving.
