FELONY FLEEING CHARGE — DISMISSED.

Another major victory for Lesch Law Firm.

Our client was charged in Dakota County with Felony Fleeing a Peace Officer in a Motor Vehicle, an offense carrying the possibility of prison and a felony conviction. The allegation arose from a high-speed incident on Highway 52.

But speeding and felony fleeing are not the same thing.

From the beginning, our defense focused on a critical element the State still had to prove beyond a reasonable doubt: Did our client actually know that police were attempting to stop him and intentionally flee?

The evidence gave us substantial grounds to challenge that conclusion. Our client consistently maintained that he did not realize the officer was behind him until the end of the incident. The officer himself acknowledged that this was our client's explanation, and the body-camera evidence gave us significant material to challenge the State's theory of intentional fleeing. We prepared the case for trial and kept pressing the weaknesses in the State's proof. A jury trial was set for Monday.

Today, the Dakota County Attorney dismissed the entire complaint.

Felony charge: DISMISSED.
No plea. No felony conviction. Case over.

A criminal charge is an accusation. The details matter. The evidence matters. And sometimes the difference between a felony conviction and a dismissal is making the State prove every element of its case.

VICTORY BEFORE WE EVEN WALKED INTO COURT.
We were prepared to appear Monday for an implied-consent DWI hearing challenging our client’s driver’s-license revocation.

Our position was straightforward: police entered our client’s home without a warrant after he had expressly refused them entry. We prepared the evidence, submitted the body-camera footage, and were ready to litigate the constitutional issue.

Yesterday, after reviewing our submissions, the Minnesota Attorney General’s Office administratively rescinded the license revocation. The hearing is no longer necessary.

When the government takes away your driving privileges, you have the right to challenge it. Sometimes being prepared to fight the case all the way through is exactly what produces the result.

License revocation rescinded. Victory for our client.

We secured another dismissal for our client! In this case, the alleged victim did not disclose all the facts around the crime she accused our client of. When we presented those to the state, the prosecutor dismissed.
