With the death of Supreme Court Justice Antonin Scalia in February 2016, many in the legal community are wondering openly who would take his place. While people are arguing over who should appoint the next Justice (Obama or the next President), we need diversity at our highest Court. History tells us that we didn't have a non-White Justice for the first 191 years of our country's existence until the appointment of Justice Marshall in 1967. Since then, only two non-White justices have been appointed (Thomas and Sotomayor). President Obama appointed the first Latino to the Supreme Court when he appointed Justice Sotomayor in 2009. I am hoping he will make history again by appointing the first Asian to the Supreme Court in 2016!

It is illegal in Minnesota to refuse to submit to a chemical test if you are suspected of DUI. Minnesota is one of the first state to criminalize refusal to a chemical test. The US Supreme may take a closer look at this law to determine whether Minnesota (and a few other states) has gone too far to encroach on people's Fourth Amendment right against unreasonable searches and seizures.

Minnesota is one of a handful of U.S. states that have criminalized the refusal to submit to a warrantless search in suspected DUI cases. This term, the U.S. Supreme Court will review a Minnesota case as it determines whether states can make refusing to submit to a warrantless search a criminal act.
