In a criminal trial, the state has the burden of proof. That does not change during the trial. This is a foundational tenant of our criminal justice system created with the intent to reduce as much as possible convictions of innocent people. Even with this high burden, the state has advantages that only the wealthy are able to match. A police force to investigate. Crime labs and forensic scientists and experts at their disposal to name a few . Favorable rulings from the courts and a tendency of the courts and the law to permit their evidence and view the state position as credible. But we can and do overcome these obstacles.
