Employers and employees, take note!
Starting January 1, 2025, the minimum wage in New York is increasing. If you’re a minimum wage worker, review your next paycheck to ensure your pay rate increased accordingly. And if you’re an employer, be sure to update the rate of pay due to your workers!

As of 01/01/2025, the updated minimum wage rates are:
💰NYC, Long Island & Westchester: $16.50/hour
💰The rest of New York State: $15.50/hour

Some workers are entitled to higher minimum wage rates that will also increase in the new year. Examples of two such categories of workers are listed below.

Minimum Wage for Home Care Aides:
💰NYC, LI & Westchester: $19.10/hour
💰The rest of New York State: $18.10/hour

Minimum Wage for App-Based Delivery Workers in NYC:
💰$19.96/hour (starting April 1, 2025)

New York’s Clean Slate Act is officially in effect as of November 16, 2024.

The act significantly impacts how criminal records are handled within the state. Within the employment context, it has important implications for both employees and employers.

For employees with a past criminal conviction, the Clean Slate Act may offer a path to new opportunities. Eligible convictions will be automatically sealed after waiting periods of 3 years for misdemeanors and 8 years for felonies. Sealing can open doors to better employment and housing opportunities that may have previously been out of reach. Also, sealed records won’t appear in most background checks. Advocates for the law believe this change will help reduce discrimination based on past mistakes, offering individuals a true second chance.

NY employers who conduct background checks should update processes as necessary to give job applicants access to their criminal history report, which they can also correct if errors are discovered. This increased transparency aims to ensure fairness in the hiring process. Importantly, employers in healthcare, childcare, and other sensitive fields will still have access to sealed records when required by law, maintaining important safeguards.

The Clean Slate Act represents a significant shift in New York’s approach to criminal records and employment. It aims to strike a balance between public safety and second chances, potentially expanding the labor pool and increasing opportunities for a motivated sector of the workforce.

Note: the law does not change existing protections against discrimination based on criminal history. Employers should review their hiring policies and consult legal counsel to ensure compliance with the new requirements.

Election Day is just around the corner on November 5, 2024. Many of us will have to work on Election Day, which could make it hard to get to the polling center. One option is to vote early but if you do not do that, you might also be able to get paid time off on November 5th in order to vote. Not enough people know that this is an option!

In New York, if your work schedule doesn’t allow you at least 4 consecutive hours to vote while the polls are open, you are entitled to up to 2 hours of paid time off to cast your vote.  Your Employer cannot force you to use paid time off if you’re eligible for this based on your schedule. The paid leave must be taken at the beginning or end of your shift, unless your employer agrees to another scheduling arrangement. Note that you do need to notify your employer at least two working days in advance if you require this time off. 

Employers are also required to post a notice about voting leave rights at least ten days before the election. 
10 days before the upcoming election = October 26, 2024. In other words, by this Saturday, employers in New York should be sharing information about voting rights with all their workers.

Important Update: U.S. Government Tightens Asylum Restrictions

The Biden administration has announced new, stricter asylum regulations at the US-Mexico border, effective October 3, 2024.

We have prepared a brief summary of some of the important information from the announcement:

• The new rules extend the period required for lifting asylum restrictions from 7 days to 28 days.

• Asylum access will be limited when border crossings exceed an average of 1,500 per day over the 28-day period.

• All children, not just those from Mexico, are now included in the daily count.

• The announced changes may make it more challenging to lift restrictions and apply for asylum if the applicant entered the country outside official border crossings.

A reminder for all New Yorkers of their whistleblower rights:

Considering the news coming out of NYC right now, it seems particularly timely to point out that New York has strong whistleblower protection laws. These laws, which were expanded in 2022, shield employees and independent contractors who report illegal or dangerous activities at work. They also cover former employees.

Whistleblowers can be protected from retaliation if they disclose violations of law or practices that pose a substantial danger to public health or safety. The protections are meant to cover both public and private sector employees, regardless of their immigration status. Whistleblowers may be safeguarded from termination, demotion, suspension, or other adverse actions. The laws also extend to those who provide information to government bodies during an investigation.

Anyone who has ever been on the subway has probably seen the city’s instruction, “If you see something, say something.” This phrase can, and should, be applied to illegal and unsafe activity in the workplace.

The Freelance Isn’t Free Act (FIFA) is now officially enacted across New York State. This legislation extends protections to freelance workers throughout the state, ensuring they receive fair treatment and timely payment for their services.

Key Highlights of FIFA:
- Written Contracts: Freelancers must have a written contract for work valued at $800 or more, ensuring clarity and transparency in agreements.

- Timely Payment: Payment must be made within 30 days of work completion unless otherwise specified in the contract.

- Protection Against Retaliation: Freelancers are safeguarded from any form of retaliation when asserting their rights under this law.

- Damages and Legal Remedies: Freelancers can pursue legal action if clients fail to comply with the law and are entitled to seek payment of double damages, along with attorney fees and costs.

This statewide law builds upon New York City’s Freelance Isn’t Free Act, which has been in effect since May 2017, providing similar protections for the past seven years.
