Congratulations to Pratt Vreeland President, Jeff White, who persuaded a unanimous Vermont Supreme Court to reverse a trial court decision holding that an easement for ingress and egress implicitly included a right to run utility wires beneath the easement. Gladchun v. AT&T, et al.

Vermont Business Magazine has informed us that we received the most votes for Vermont's Best Bankruptcy Law Firm in its annual Best of Business readers' poll. Apparently the poll had 68,000 votes this year. We are grateful to the bankers and other creditor clients that apparently voted for us. The May edition of the magazine will apparently have more information about our firm and the other winners. Jack Kennelly is the leader of that practice group and is President of the firm.

Pratt Vreeland Kennelly Martin & White, Ltd. is pleased to announce that Shannon E. Lamb has become a principal of the firm and that Bridgette L. Re*****on has joined the firm, of counsel.

Attorney Lamb is a 2015 graduate of Vermont Law School. She interned with the firm while in law school, primarily under the direction of Robert S. Pratt. Her practice primarily focuses on elder law, including estate planning and probate administration. She also frequently handles real estate transactions and evictions on behalf of the firm’s commercial and residential landlord clients.

Attorney Re*****on grew up in Rutland County, graduated from the University of Vermont, and earned her law degree from Vermont Law School, cm laude. She previously served as a Hearing Officer for the Vermont Public Utility Commission and then worked in private practice. In private practice she represented Vermont property developers with energy permitting and regulation, and then later, with a respected local firm, broadened her practice to include the representation of individuals and businesses in defense of lawsuits. Her work with PVKM&W’s clients will draw upon her experience and training in the areas of environmental law, utilities, energy, income tax, estates, property development, personal injury and insurance matters.

Pratt Vreeland partner and insurance lawyer Matt Anderson recently took a Webinar on the ability of businesses to make insurance claims under their property and casualty policies' "business interruption" coverage for corona-related losses. Policy language differs from policy-to-policy but most require that there be some actual physical damage to the business premises for this coverage to be triggered. The presenters took the view that this requirement might be met if the business interruption came about due to corona virus particulates actually entering the building via an infected employee or customer. The theory being that the particulates actually physically damaged the premises by contaminating them, thereby requiring the shutdown for remedial sanitation.

The insurers are expected to disagree with this argument, thus requiring litigation, but if a business suffered $50,000 or more in losses after the premises were infected by corona virus the fight might well be worth it.

Matt Anderson has become a member of the Vermont Association for Justice (VTAJ). The VTAJ exists to advance the effectiveness of its lawyer-members' litigation efforts through networking, information sharing and education. Members must devote at least 90% of their injury litigation practices to representing injured plaintiffs.

Congratulations to Pratt Vreeland co-founder Robert S. Pratt who has been elected as a fellow to The American College of Trust and Estate Counsel.

In order to become a Fellow of ACTEC, one must:

1. Have been in the active practice of trust and estate law for at least 10 years or have served as fiduciary counsel with a fiduciary services firm no less than 10 years;

2. Have (a) presented recognized professional and educational seminars to lawyers where scholarship and quality of legal expertise are important and recognized; (b) published scholarly articles dealing with trust and estate law; and/or (c) been involved in State Bar activities related to the trust and estate practice, such as serving in a leadership position in the Trust and Estate Section of your State Bar Association;

3. Have made substantial contributions to the T & E field by lecturing, writing, teaching, or being involved in bar activities or in the enactment of significant state or federal T & E legislation;

4.. Be nominated by a Fellow from your state; and

5.. Be approved by your State Membership Committee and State Chair, after all Fellows in the state have reviewed the nomination papers and have been polled on the nomination, and thereafter recommended by the National Membership Committee for election by the Board of Regents of the College.
