When an insurance company offers you money shortly after an accident, it can feel like things are moving in the right direction. But the insurance company is not on your side. Early offers, though, often don't fully account for the pain and suffering you have and will endure.

Insurance companies make early offers to try and take advantage of you while you are vulnerable and before you can consult with a legal professional who better understands the value of your case. An early offer from the insurance company might not be enough to cover your future medical costs, the time you've lost from work, or the long-term effects of your injuries. Worst of all, once you accept a settlement, you can't go back for more money, even if your condition gets worse.

Before accepting anything, you should consult an attorney who will look at:

✔️ Where you are in your treatment: Settling before you're done with treatment, or before your doctors know what your recovery will look like, can leave future costs uncovered.

✔️ Everything you've lost: Medical bills, lost income, reduced ability to work, and the ongoing effects of your injuries all factor into what your claim is actually worth.

✔️ How strong your case is: How clearly the other side is responsible affects your position and what you can reasonably expect to recover.

On October 30, 2019, Xuefang Zhong stepped off a New Jersey Transit bus at the Port Authority Bus Terminal and opened the luggage compartment to retrieve her bag. She was still partly inside the luggage compartment when the driver pulled away, running over and crushing her.

The 72-year-old home health aide lost her right leg, amputated below the knee. She sustained spinal fractures and multiple fractures to her right arm, leg, and left foot. She underwent numerous operations at Bellevue Hospital, then months of rehabilitation, during which she was fitted with a prosthetic leg.

New Jersey Transit vigorously fought the case by arguing, in part, that Ms. Zhong was partly at fault because she failed to notify the driver before accessing the luggage compartment. Under New Jersey law, if she were found 50% or more responsible, she would recover nothing.

The bus driver's own testimony defeated that defense. He admitted he was pulling away while Ms. Zhong was still in the compartment and that she should not have had access to because New Jersey Transit’s own policy required him to keep it locked. His admission that he left it unlocked for passengers proved he violated the safety protocols.

After years of contentious litigation, David Mazie and Adam Epstein secured a $10 million settlement.

Xuefang had been working 68 hours a week as a home health aide, caring for others. The settlement compensates a woman now facing permanent disability from an accident that should never have happened.

This accomplishment has been made possible because of all the people who have been in my corner along the way. Thank you to all my colleagues, staff members, mentors, former employers, adversaries, clients, family members and friends for everything you have done for me! Amongst his accomplishments, Cory has recovered million dollar settlements for his clients, including a record $10 million civil rights settlement as well as $4.9 million and $1.6 million settlements for truck crash victims.

Beyond trial work, Cory serves as Secretary of the Essex County Bar Association and is in-line to become its 132nd President in 2029. Last week the Essex County Bar Association held a dinner for its Past Presidents. As a current Officer, I was lucky to be a part of this incredible evening, and what will hopefully become an annual tradition. It was a privilege to hear stories of the past and learn from the leaders who have helped make the ECBA the wonderful organization that it is.
