VACCINE WAIVER WITH CONCURRENT ADJUSTMENT OF STATUS APPLICATION
Yes, you can apply for this waiver during concurrent adjustment of status application process. There are specific steps to follow when applying for adjustment of status and when applying for consular processing.
I-601 & Adjustment of Status
The I-601 vaccine waiver from the vaccination requirement can be filed with the initial I-485 Green Card Application and I-693, Report of Medical Examination and Vaccination Record, in the very beginning, or it can be filed later.
Filing it later means that the applicant files the I-485 first, wait for the RFE for I-693, goes for their medical exam later, and waits until after the medical exam has been completed and returned to immigration to file the vaccine waiver.
Filing it concurrently means the applicant schedules their medical exam, attend it, inform the Civil Surgeon that they are planning to file a vaccine waiver with their adjustment of status application, and decline all vaccines. Upon receipt of the medical report after a week or so, it is attached to the prepared AOS packet containing the signed Form I-601 and all supporting documentation and submitted all at once.
