The courts are allowing DOGE to proceed. Why? The court generally waits for the train wreck instead of ruling whether the conductor can conduct.

Trump has been held liable in a sexual assault case here in NY. The woman was the wife of the late John Johnson, a popular NY newsman who sported an iconic afro. Now, the case is in the damages phase (i.e., what is the case worth?). Trump and his lawyer have acted so obnoxiously in this phase, some people are saying that he is intentionally trying to get the judge to make an outrageously large award so Trump can cry to his MAGA thimbots about unfairness in the system. Amazing.

The civil war 14th Amendment bars people Involved in insurrection from federal office. This law neither said the person had to be convicted (although it could have) nor any person or president was excluded. The national government never contemplated convicting all the soldiers in the confederacy, but it sought to punish them for wrongdoing. So, no conviction needed for liability. Conservatives have used “the plain text” of the constitution to overturn many popular laws to uphold Jim Crow laws. Here, the Colorado Appellate Court used a conservative approach to the 14th Amendment to strip Trump from the ballot.

Trump is claiming that he was immune from prosecution in the 1/6 attempted coup because he was president at the time. He also claims he was impeached for it so he is exempt from prosecution because of double jeopardy. The special prosecutor has asked the Supreme Court to bypass the lower courts and rule on these issues to expedite the case. The Supreme Court agreed to look at the case. The Supreme Court must decide if a president can commit any crime while in office and have immunity.

Congestion Pricing: It looks like cars will be charged @ $15 to enter Manhattan below 60th Street. TLC Drivers will be charged $2.50 per ride. This is still in the proposal phase. However, the city is already building the ez-pass capture cameras. It looks like the city will start off low ($15) but it is a certainty the city will increase this amount as soon as they can.

Collections on Mass tort lawsuits in trouble in the Supreme Court today.

If the government or a group of individuals sue a drug cartel family for the intentional death of millions of people and they win a settlement, can the drug cartel declare for bankruptcy protection and walk away?

The scope of the bankruptcy law is in flux. This conservative Supreme Court is likely to let the Sackler family retain their profits for their creditors after making a fortune selling oxycontin.

When you apply for bankruptcy, you have to list all of your assets. The Sackler's have put a portion of their money in overseas accounts which cannot be discovered. The Sackler's want to declare bankruptcy on the money they decided to declare. The Sacklers, in bankruptcy, want to undercut the settlement based on the money they decided to reveal (@6 billion). The conservatives on the court are blaming the victims' lawyers for holding up the bankruptcy by promising the victims they will get more if they block the bankruptcy. I think that is pretty low down on the part of the court.

I have a client currently sueing Uber. My client refused to take a dog. Uber, without any evidence, referred to the dog as a “service dog” and Uber cancelled his account. A “service dog” is a particular special type of dog that must perform special tasks for the owner. Uber follows the American’s with Disabilities Act definition of “service dog”. The passenger needs no paperwork to prove the dog is a service dog but you as a driver can ask the passenger “what is your disability and what service does the dog perform.” Emotional service dogs are NOT service dogs under the ADA. Many passengers have cards printed by non ADA affiliated groups that state the dog is a service dog when in fact they are emotional service dogs. I am now in arbitration on this case. The bottom line is Uber drivers do not have to take dogs except “service dogs” as defined by the ADA. Uber has probably lost millions in cancelled jobs because of that bottom line. Cancelling accounts for your right to refuse dogs is something Uber uses to intimidate all drivers to make $ by making drivers think twice about dogs. I am taking them on. Update soon.
