$150,000 RECOVERY AFTER LITIGATION

I recently served as lead counsel in a car-accident case arising from an intersection collision.

Our client suffered soft-tissue injuries and incurred substantial medical expenses. Before litigation, the insurance company made an initial settlement offer that was less than the client’s medical expenses.

The offer did not fairly account for the documented treatment, pain, or effect of the injuries. Litigation was required to move the case forward. The claim ultimately resolved for $150,000.

Insurance companies may describe an injury as “soft tissue,” but that label does not determine how seriously the injury affected someone’s health or daily life.

An injury claim may also be evaluated through medical records, diagnostic testing, consistent symptom reporting, treatment history, testimony, and evidence showing how the person’s work and daily activities changed after the collision.

The issue should be evaluated from the complete evidence, not a bumper photograph alone.

Georgia generally provides two years for an action involving injuries to a person—but that is not a universal deadline.

The applicable time may change because of:

• The identity of the defendant
• Government ante litem requirements
• The type of claim
• The age or legal status of the injured person
• Criminal charges arising from the incident
• The date the claim legally accrued

Claims involving cities, counties, or the State may require notice much earlier than two years.

• Explain when the symptoms began
• Give providers an accurate accident history
• Follow reasonable treatment instructions
• Preserve medical records and work documentation
• Be prepared to explain significant treatment gaps

Delayed symptoms do not automatically defeat a claim, but unexplained delays may create causation disputes.
