SDAZ joined our neighbors at the Chief State’s Attorney office along with law enforcement representatives from across the state today to support Collin Genetti. Collin is a 10 year old boy with a love for law enforcement who is battling cancer. Collin arrived with a police motorcade and was able to visit with canine officers and their dogs and view some impressive police vehicles after a presentation by the CSA office. All a surprise for Collin! The smile on Collin’s face was the highlight of the morning! Go Collin!

ELLSWORTH V. PROSPECT MEDICAL HOLDINGS/WATERBURY HOSPITAL, 6573 CRB-5-25-3 (May 1, 2026)
The claimant was a psychiatric nurse who was attacked at her job by a patient. She sustained physical injuries to the neck, back and head. She sought care with Dr. Waynik, a psychiatrist. A psychiatric RME was held with Dr. Herzog who later also became a treating doctor. Dr. Herzog rated the claimant with a 15% of the brain due to her psychiatric injury. The respondents had a RME with a neuropsychiatrist, Dr. Pier, who determined that the claimant had no cognitive loss and no ratable permanency of the brain. The trial judge accepted Dr. Pier’s opinion regarding no permanency of the brain; the claimant appealed that decision and argued that Dr. Pier was not a physician and that his opinion regarding the rating could not be the basis for the judge’s finding re permanency. The CRB affirmed the finding re no rating of the brain and determined that the neuropsychiatrist’s opinion re a rating could be form the basis for a finding by the judge.

HASSELT V. LUFTHANSA GERMAN AIRLINES, 6575 CRB-7-25-4 (April 24, 2026)
The claimant sustained a compensable lumbar injury in 1994 and remained on TT until his death in 2024. Post his death, the claimant’s spouse sought permanency benefits for a rating of 25% of the lumbar spine pursuant to Connecticut General Statutes Section 31-308(d). There were ratings of 25% of the back from a RME physician and a treating doctor in 1995 and 1996. No voluntary agreement was ever issued for the 25% rating. The trial judge found that there was no “meeting of the minds” before death of the claimant for a permanency award and dismissed the claim for benefits. The CRB reversed, however, finding that the parties had stipulated to the ratings at the formal hearing and concluded that the award had vested. The Board remanded the case back to the trial judge for a determination of the award and whether the respondents should be given a credit, as they claimed they should, against permanency for the benefits that had been paid to the decedent.
