Did You Know?

A recent federal court ruling in the Southern District of New York found that a client’s communications with an artificial intelligence platform was not protected by attorney-client privilege or work-product protections.

The court reasoned that when a client shared information with an AI tool, it was disclosed to a third party, and no longer confidential. The confidentiality disclaimers of the AI platform were taken seriously in the analysis. In short: if attorney client communication is disclosed to a third party, the privilege is lost.

Practical takeaway: Speak with counsel before entering legal information into AI tools.
