Stein Sperling is representing Montgomery County in a series of significant legal challenges in state and federal court involving the County’s fi****ms law.

Jeff Schwaber appeared before the Montgomery County Circuit Court this month on behalf of the County, arguing that recent legislative changes have already addressed the provisions that the Maryland Supreme Court found problematic. “In this case, the legislature beat you to it,” Jeff told the court, explaining that the Montgomery County MD Council has since amended the law to remove the provisions at issue.

The latest hearing follows the Maryland Supreme Court’s April decision in Engage Armament LLC, et al. v. Montgomery County, Maryland and raises important questions about what relief, if any, remains necessary following the County Council’s subsequent changes to the law.

The County’s motion to dismiss remains pending.
