USCIS Quietly Ends Automatic EAD Extensions for New Filings

A major shift in USCIS policy has taken effect without prior notice: automatic extensions of Employment Authorization Documents (EADs) are no longer granted for renewal applications filed on or after October 30, 2025.

This change affects a wide range of individuals who rely on EADs to maintain lawful employment in the United States.

Who Is Affected:
1. H-4 spouses with EADs
2. Adjustment of Status (AOS) applicants
3. Asylum seekers, refugees, TPS holders, and others depending on EAD renewals

Key Impacts:
1.The 540-day automatic extension previously granted for timely EAD renewals is no longer available
2. Work authorization ends when the current EAD expires unless the renewal is approved beforehand
3. Receipt notices for EAD renewals no longer provide interim work authorization

What You Should Do Now:
1. File EAD renewals up to 180 days in advance this is the maximum early filing window allowed by USCIS
2. Employers should track EAD expiration dates closely to avoid employment gaps and I-9 compliance issues

Who Is Not Affected:
1. Individuals who filed EAD renewals before October 30, 2025
2. Those currently within their 540-day automatic extension period
3. F-1 STEM OPT applicants still benefit from a separate 180-day auto-extension provision
4. Certain categories like TPS-based EADs may still be protected under separate regulations

No Prior Announcement. This rule change was implemented via an interim final rule with no public notice or comment period, leaving many applicants and employers unprepared.
