In one of our current class action cases, we submitted two questions of law to Maryland's high court. The court decided "no" on one question, and "yes" to the other. As a result, unlicensed Maryland landlords cannot attempt to collect any delinquent rent without violating the law. They also cannot file "failure to pay rent" lawsuits against their tenants. And if the landlord eventually obtains a license, it cannot attempt to collect, or evict, based on nonpayment of rent for the months that it was unlicensed.

The Court's holding goes for tenants across Maryland in jurisdictions where a rental license is required, including Montgomery County, Prince George's County, Howard County, and Baltimore City.

If Experian lures you to their website with promises of a higher credit score, or extra security, BE CAREFUL! Experian is slipping arbitration clauses that consumers "agree" to when they sign up for Experian services. And yes, we've seen a troubling pattern of Experian compelling arbitration when they are sued.

Earlier this month, one of our clients got a great opinion from Judge Chuang of the United States District Court for the District of Maryland. The Court denied a debt buyer's motion for summary judgment. Unfortunately, this debt buyer has prevailed in other jurisdictions on the same legal theories that it employed in our case, but it didn't work this time.
