Lindsay Clancy opening statement commentary by a criminal defense attorney.

an opening statement can make or break your credibility with a jury throughout a trial.

In a case is highly emotionally charged as this one you have to be careful not only in your factual presentation, but the tone of your presentation.

The prosecutor got it all wrong here. If you look over the Internet at amateur expert criminal justice commentators, even the most hardened, most judgmental, people have reservations about this case.

In a case, like this, a prosecutor would have to convince people on the fence to go along with them for a conviction. And in this case, the prosecutor did a horrible job. I don’t know this prosecutor. I don’t practice in that state. But even as a tactician, it was a horrible approach.

I think the criminal defense attorney could’ve done better. It was a bit repetitive and rambling however, he was able to get to the emotional tone of the case. He was talking about what everyone was thinking and that’s what you have to do with your jury.

In 2010, Jamaal Alexis (left, with his attorney, Justin Eisele) was convicted of murder and other crimes in Prince George's County, Maryland. Alexis received a new trial in 2022, after a judge ruled that the state had failed to disclose exculpatory impeachment evidence, and he was acquitted at a retrial in 2026.​

Another day, another dismissal ✅

Our client was completely innocent—someone else had a warrant issued under his name. We dug deep, stayed persistent, and refused to back down.

On our second motion, the judge recalled the warrant. Had that not happened, our client would have been forced to turn himself in just to get the case moving.
We presented everything to the
prosecutor, and the night before trial, the State dismissed the case.

A win like this? Worth celebrating. Our client even wanted a photo with Justin 📸
