Case Dismissed. We obtained an order of dismissal from the Supreme Court, Nassau County (Cozzens J). Our client was sued by her former daughter in law for Conversion and Unjust Enrichment. The Plaintiff (who herself is an attorney) sued our client claiming Plaintiff’s ex husband (Defendant’s son) diverted marital assets to our client prior to a judgment of divorce. The Court dismissed the lawsuit pursuant to the doctrine of Res Judicata, holding that the claims were or “could” have been adjudicated in the prior NY County matrimonial litigation.
