Memorial Day was started by local communities to honor the lives of fallen soldiers who served our country. People would visit and decorate gravesites, and organized parades to remember the fallen. Eventually, it became a national holiday. As we gather today with loved ones and friends, as we cook over the grill and toast the sunshine, let us each take a moment to reflect and remember. Remember the son, the daughter; the husband, the wife…the friend and the neighbor. Remember the ones who never made it home. Remember the willing and the brave. Happy Memorial Day.



El Memorial Day fue instituido por comunidades locales para honrar las vidas de los soldados caídos que sirvieron a nuestro país. La gente visitaba y decoraba las tumbas, y organizaba desfiles para recordar a los caídos. Con el tiempo, se convirtió en un día festivo nacional. Al reunirnos hoy con seres queridos y amigos, mientras cocinamos a la parrilla y brindamos bajo el sol, dediquemos cada uno un momento para reflexionar y recordar. Information you or someone you may be wondering about. Can a person change a person's will as a Power of Attorney?

No, a power of attorney cannot change someone's will under Illinois law. The Illinois Power of Attorney Act explicitly prohibits an agent acting under a power of attorney from making or changing a will on behalf of the principal. This restriction is clearly stated in
755 ILCS 45/3-4 Explanation of powers granted in the statutory short form power of attorney for property., which provides that an agent may not make or change a will, even if the agent is granted broad powers under the power of attorney. 755 ILCS 45/3-4 Explanation of powers granted in the statutory short form power of attorney for property.. Similarly, 755 ILCS 45/2-9 Preservation of estate plan and trusts. reinforces this limitation by stating that an agent cannot revoke or amend a trust revocable or amendable by the principal without specific authority, and it does not extend to making or altering a will

Case law also supports this principle. In LeMaster v. Coffman ( In re Estate of Coffman), 2022 IL App (2d) 210053 (In re Estate of Coffman), the court emphasized that a power of attorney document does not grant the agent the authority to make or change a will, even if the agent exercises other powers under the document

Zierau, the Illinois Supreme Court held that the power to change or alter provisions of a will is equivalent to the power to revoke, which cannot be delegated to another person
Zierau v. Zierau, 347 Ill. 82.

In conclusion, under Illinois law, an agent acting under a power of attorney does not have the authority to make or change a principal's will.
