Every new year brings new laws. Here is a summary of some of the changes to criminal law beginning 1/1/2026.
1) The Illinois Clean Slate Act (HB 1836) creates a framework for the automatic sealing of eligible non-violent conviction records. The State Police will begin working on this right away, but the bulk of the automation is not expected to be fully operational until 2029.
2. Unfit Misdemeanant Diversion (HB 3572) allows for defendants charged with misdemeanor offense who are found "unfit to stand trial" can now be diverted to mental health or substance use treatment.
3. Older Adult Renewals (HB 1226) increases the age from 75 to 79 for mandatory in-person license renewals. However, drivers 87 and older will still require a road test.
4. First-Time Weapon Offender Diversion (SB 1899 / PA 104-0398) provides a new path for gun rights by allowing individuals who successfully complete a "First-Time Weapon Offender Diversion Program" for low-level possession charges to apply for a FOID card.
5. The Safe Gun Storage Act (PA 104-0031) creates stricter requirements for securing fi****ms if a minor or a "prohibited person" could access them.
Also, lost or stolen fi****ms must now be reported to police within 48 hours.
