El viernes, se filtr贸 un memorando del Departamento de Seguridad Nacional ("DHS") sobre c贸mo ICE debe tratar a las personas que son v铆ctimas de delitos. Este memorando le da a ICE cuatro directrices, que se enumeran a continuaci贸n. Es importante saber que este memorando NO:

-Cancela el programa de Visa U ni la Acci贸n Diferida actual basada en la determinaci贸n de buena fe o decisiones de lista de espera.

-Realiza cambios en el proceso de adjudicaci贸n de las solicitudes de Visa U, Visa T o VAWA.

-Elimina la determinaci贸n de buena fe, las decisiones de lista de espera o la acci贸n diferida para la Visa U.

-Elimina la acci贸n diferida para VAWA o Visas T.

Las directrices de ICE en el memorando son:

1) Coordinar con las fuerzas del orden para asegurarse de que la ejecuci贸n de ICE no interfiera con sus procesos judiciales.
2) ICE debe comunicarse con la fiscal铆a de inmigraci贸n del gobierno antes de tomar cualquier acci贸n contra una persona que sea beneficiaria de un beneficio migratorio basado en v铆ctimas (Visa U, Visa T, VAWA).
3) ICE no est谩 obligado a investigar si una persona no ciudadana es v铆ctima de un delito ni a informarle que puede ser elegible para un proceso migratorio con USCIS si la encuentra en esa condici贸n.

4) ICE no solicitar谩 que se acelere una petici贸n de Visa U pendiente ante USCIS.

Ayer, la administraci贸n de Trump anunci贸 que el Proceso de Expulsi贸n Acelerada (tambi茅n conocido como deportaci贸n) se ha ampliado de 100 millas desde cualquier puerto de entrada a abarcar todo el territorio de los Estados Unidos. Si no es ciudadano estadounidense o residente permanente legal, es muy importante llevar consigo en todo momento documentos que demuestren que ha estado residiendo en los EE. UU. durante al menos 2 a帽os.

Ejemplos de documentos que puede utilizar incluyen:

-Identificaciones estatales o licencias de conducir emitidas hace al menos 2 a帽os.
-Copias de los certificados de nacimiento de sus hijos.
-Copia de su certificado de matrimonio.
-Facturas o cualquier tipo de estado de cuenta que muestre su nombre y actividad de pago con fechas.
-Una carta de su banco que indique la fecha en que abri贸 la cuenta y que la cuenta ha estado activa y en buen estado desde esa fecha.

Yesterday, the Trump administration announced that Expedited Removal (otherwise known as deportation) has been expanded from 100 miles from any port of entry to across the entire United States. If you are not a U.S. Citizen or Lawful Permanent Resident, it is very important to keep documents showing that you have been residing in the U.S. for at least 2 years with you at all times.

Examples of documents that you can use are:

-State IDs or driver's licenses issued at least 2 years ago;
-copies of your children's birth certificates;
-copy of your marriage certificate;
-bills or any type of billing statement showing your name and payment activity by date;
-a letter from your bank stating the date you opened the account and that the account has been active and in good standing since the date you opened it.

Yesterday, a Judge in Texas put a temporary halt to the new USCIS Family Unity program for spouses of US Citizens for 14 days. Applications can still be filed with USCIS, but no decisions on the applications can be made.

This is an important program for so many families. The current administration has prevailed before in litigation over its enforcement priorities. We will keep filing these applications for all clients who wish to move forward. Such a decision should be made in consultation with your attorney.

Today President Biden announced a new program that will allow certain undocumented spouses of US Citizens to apply for their residency without leaving the US. Eligible applicants will:

1) Have been married to a U.S. Citizen as of June 17, 2024;

2) Have entered the U.S. without inspection;

3) Have been continuously present in the United States for at least 10 years (on or before 6/14/2014);

4) Have no disqualifying criminal history;

5) Merit a favorable exercise of discretion.
