When I say we "won" 11 trials in a row, I am not using some figure of speech like "well we beat the offer" or "we beat a smaller included charge". I mean we objectively won. Looking again, we've won 17 of the last 18 cases.
And I got to thinking that people may not believe us or they may think we are messing with the numbers. So here they are. All the info.
If you want to be picky, here are the only 3 important clarifications:
1. There are a few disorderly conduct charges that the jury did decide "guilty" on when we beat the assault cases. These were never contested. By design, we never even argued to the jury they shouldn't convict on the Disorderly charges. Same with one of the r**e cases. We admitted the assault charges and challenged the r**e on which the jury found NG. There was an assault-strangulation charge that was not conceded that was a "guilty" but it was worth about 1/5 of the time he was looking at on the r**e charge. So if you want to be nit-picky, this is where you should do it.
2. One case was a hung jury; meaning it was a mistrial. It was never retried because the prosecutor dismissed the charges afterword. Any trial lawyer will tell you, that's a damn win. 100%. If it was recharged and we lost at trial or took a deal later it would be a different story, but that's not what happened here.
3. One case had a felony that we won at trial with a Judgment of Acquittal - meaning the judge found not guilty before the jury could. The jury then found 'guilty' on the gross misdemeanor charge. That's probably the closest we can get to a "non-win" even though we beat the felony at trial.
So there you have it. 18 cases. 17 wins. Dont get me wrong, we've lost a lot of trials in our careers as well. No result is ever guaranteed. But damn it feels good to have a team that can pull off such an amazing recent trial record.
