Ganguly Brothers Misula PLLC Expands Litigation Practice with New Hire

ROCHESTER, N.Y. — Ganguly Brothers Misula PLLC has added Thomas Ambalavanar, Esq. as an associate attorney, expanding the firm’s civil litigation capacity as part of its continued growth in the Rochester market.

Ambalavanar’s practice focuses on civil litigation, including financial disputes, municipal and zoning matters, Article 78 proceedings, and administrative hearings. His addition supports the firm’s strategic initiative to broaden its ability to serve individuals, entrepreneurs, and small to mid-sized businesses with responsive, high-level legal representation.

JUDGES AREN’T TO BLAME — THEY’RE FOLLOWING THE LAW ⚖️

New York’s bail reform gets a lot of heat — but judges aren’t the problem.

🔹 By law (CPL § 510.10), judges can only set bail based on risk of flight — not on whether someone seems dangerous.
🔹 Bail is allowed only for “qualifying offenses” — like serious violent felonies, certain domestic violence or terrorism charges, or crimes committed while already out on release.

⛔️ Crimes that sound serious — like drug possession or making threats — often don’t qualify under the law.

🎯 Bail is not a punishment. It’s meant to make sure people come back to court. 👩‍⚖️ These reforms were designed to stop locking people up just because they’re poor.

😤 So if you’re frustrated, direct that frustration to Albany, not the courts.
Judges are just following the law they were given.

Federal vs. State Bail – What’s the Difference?
Ganguly Brothers Misula PLLC | Rochester, NY

If you or a loved one is arrested, the bail process can look very different depending on whether it’s a federal case or a New York State case.

🔹 In New York State courts, bail is usually set to make sure the person comes back to court. Judges can set cash bail, bond, or release the person without any money on “ROR” (Released on Recognizance). Recent reforms now limit cash bail for most non-violent cases.

🔹 In federal court (like in the 2nd Circuit), the focus isn’t just on whether someone will return to court — it’s also on whether they pose a danger to the community. Judges often hold a full hearing to decide if the person should be released, and there’s no set bail schedule. In fact, many people are released without paying any money but under strict conditions (like house arrest, curfews, or ankle monitors). Others may be held without bail at all if the court finds them too risky.

Bottom line: bail works very differently in federal court. Don’t assume what happens in a local courtroom applies in federal cases — or vice versa.

New York is expanding its use of red light cameras, speed cameras, and license plate readers — but what does this mean for YOUR rights?

🔍 Privacy Risks
These systems collect more than just a snapshot — they log where you go, when, and how often. While some laws try to protect this info, the risk of misuse and surveillance creep is real.

⚖️ Due Process in Danger
You can now get fined just for owning the car, even if someone else was driving. These laws shift the burden onto the vehicle owner, potentially violating your constitutional presumption of innocence.

🛑 Red light in Rochester? That program got the axe in 2016 after a study showed more harm than good, especially in lower-income areas.

We represent individuals and organizations in complex civil and criminal cases in both state and federal court, including commercial litigation, criminal defense, personal injury, and matrimonial disputes. Our clients include private individuals, businesses, nonprofit organizations, churches, and public entities such as local government.
We are seeking a full-time Litigation Associate Attorney who is committed to excellence in advocacy, thrives in a collaborative environment, and is ready to take on meaningful responsibilities from the outset.
Responsibilities:
Handle all aspects of litigation, including legal research, drafting motions and pleadings, conducting discovery, and appearing in court.
Participate in client meetings, negotiations, depositions, and trial preparation.
Work closely with partners and senior attorneys on active litigation and contribute to firm-wide strategy.
Represent a diverse clientele including government agencies, community-based organizations, and faith-based institutions such as churches and non-profit corporations.
Qualifications:
Admission to practice in New York State (or eligible for prompt admission).

🚨 CHANGES to NYS DMV Point System – PART 1 🚨

New York State has updated its DMV point system, making certain violations more serious than ever. If you drive in NY, you NEED to know these new penalties to protect your license!

📌 🚗 Registration Violations Now Cost 5 Points!

If your vehicle registration is expired or improperly maintained under VTL § 401, the DMV will now hit you with 5 points on your license. That’s as serious as:
🚍 Passing a stopped school bus (§ 1174[a])
📱 Using a cell phone while driving (§ 1225-c[a]) (People v. A. N., 44 Misc. 3d 269)

💡 Before this change, registration violations didn’t carry such harsh penalties—but now, NYS is cracking down!

🚫 Driving Without a License? That’s 5 Points Too!

Under VTL 509(1) (“Unlicensed operation of a motor vehicle”), driving without a valid license will now cost you 5 points—a high-risk violation just like school bus violations and cell phone use.

📌This is NOT a minor offense anymore! It’s classified as a “high-point driving violation” under 15 NYCRR 132.1(c) and 136.5(a)(2)(iii) (People v. A. N., 44 Misc. 3d 269).

⚠️ Why This Matters:

If you commit a high-point violation, you could face serious consequences:
📜 Lifetime Review – The DMV can review your entire driving history, especially if you have serious violations in the past 25 years.
⛔ Potential Lifetime License Revocation – If you have a history of bad driving, a high-point violation could lead to a permanent loss of your license!

🚦 How These Compare to Other Violations:

🏎️ Speeding 11-20 mph over the limit (§ 1180[d]) – 4 points
🚍 Passing a stopped school bus (§ 1174[a]) – 5 points
