Answer: If the officer is making an official inquiry and intending to arrest you, they need to read your Miranda rights. If they're simply asking questions, they do not.

Question: "Can a police officer take my driver's license even if I haven't been convicted of a DWI?"

Answer: Yes, they can. But that doesn't mean your license is invalid. Your license doesn't actually get suspended until a decision is made after an administrative license review hearing.

Answer: Yes. Police use other ways to determine whether or not you've been driving while intoxicated. These other methods have nothing to do with your BAC level.
