AI is becoming part of the legal profession, and lawyers can use it as a tool to organize information, review documents, identify issues, and prepare preliminary drafts.

But using AI doesn’t transfer responsibility.
Lawyers remain responsible for verifying legal authorities, protecting client confidentiality, exercising independent professional judgment, and standing behind the final work product.

Technology may change how legal work is performed.
Professional responsibility does not.

The office may close. The responsibility doesn’t.

When someone trusts you with a case that could affect their health, their family, and their future, it’s not always easy to simply switch it off at 5:00.

Sometimes you’re reviewing records. Sometimes you’re thinking through an insurance issue. And sometimes, long after you’ve left the office, a detail about a case suddenly clicks.
That’s part of taking someone’s case personally.

To Others, It’s Just Business. For Us, It’s Personal.

AI can be useful for brainstorming after an accident, but remember: what you type may create a digital record.

Depending on the circumstances, AI conversations and other electronic information could become relevant during litigation and may be compared with medical records, statements, social media, or other evidence.

That doesn’t mean every AI conversation is automatically evidence or that asking a question proves anything. Context matters.
The important thing is to be accurate, consistent, and transparent with your lawyer.

Your digital activity can become evidence. Treat it accordingly.

To others is just business, for us its personal.

“Felt fine after the accident, so I didn’t see a doctor.”

I’ve heard that many times over my 25+ years practicing personal injury law. Sometimes people decline an ambulance. Sometimes they don’t go to the ER. Sometimes they wait a few days to see how they feel.

And there can be perfectly reasonable explanations for those decisions.

But here’s the problem: The insurance company may not see the situation the same way you did.

A delay in treatment can lead to questions about the severity of an injury, causation, and whether the accident actually caused the symptoms being reported.

And in Florida, there’s another important consideration: PIP generally requires initial services and care within 14 days after the accident for PIP medical benefits to apply.

So my advice isn’t, “Go to the doctor because it will help your lawsuit.”

It’s simple: “If you’re injured, take care of yourself.” When in doubt, get checked out. Your health comes first.

“I’m sorry. You don’t have UM coverage.”
That’s a conversation I never want to have with a seriously injured client.

Florida’s auto insurance can be expensive, and I understand why some drivers choose to lower their premiums by reducing their UM/UIM limits or rejecting the coverage altogether.

But that decision can come with a serious risk. The Insurance Research Council estimates that about 38.3% of Florida drivers are uninsured, roughly 4 out of every 10.

And that doesn’t even account for drivers who have insurance but don’t carry enough bodily injury coverage to fully compensate someone who suffers serious or catastrophic injuries.

That’s why when you review your auto policy, you need to ask “How much protection do I have?”
If your policy shows that UM/UIM coverage was rejected or reduced, Florida law has specific requirements governing that decision.

Do you know if you have UM/UIM coverage and if so, how much?

A viral video can show you what happened, but it doesn’t always tell you who was responsible.

In this crash, the available camera angles don’t clearly establish which driver caused the collision. That’s why a thorough investigation of the scene and available evidence can be critical.

For the pedestrian involved, the situation can be even more complex. If evidence shows that both drivers contributed to the crash, there may be potential claims against both parties.

And if the available insurance coverage isn’t enough to cover the pedestrian’s damages, Uninsured/Underinsured Motorist coverage may also become important.

The lesson? Don’t assume liability from a viral video alone. In a serious accident, the evidence needs to tell the story.
