The Sixth District Court of Appeal ended a 62-year-old prerequisite for expert testimony on the process for awarding attorney fees in the trial courts it oversees.

“There was never any legal basis for the expert testimony requirement, or the requirement for universal evidentiary hearings to which it led, and these judicially invented requirements have caused the misspent expenditure of hundreds of thousands if not millions of hours of time by attorneys and judges across our state since their wrongful inception," reads the panel opinion, written by Judges Joshua A. Mize, Roger K. Gannam and Joshua Pratt.

Warning: Reliance on Fake AI cases. Court stops short of sanctioning fees.

In a recent family law case, the 4th DCA scolded the wife, for attempting to persuade the court with fake court opinions. Even through the wife was representing herself she was held to the same standard as a reasonably competent attorney. In their opinion, the court said the "[w]ife's answer brief is replete with and entirely supported by fake cases and legal propositions, presumably generated by artificial intelligence (AI). For example, Wife cites to “Stone v. Stone, 682 So. 2d 168 (Fla. 4th DCA 1996)” and “Hedrick v. Hedrick, 132 So. 3d 1241 (Fla. 5th DCA 2014)” for the proposition that a party claiming inherited property must provide documents of transfer or other formal proof of inheritance. These cases do not exist, and no cases stand for that proposition or various other contentions in her brief."

Operación de ICE dirigida a menores, 3 de octubre de 2025. ICE está lanzando hoy, viernes 3 de octubre, una operación a nivel nacional, supuestamente llamada “Freaky Friday”, que tendrá como objetivo a niños no acompañados de 14 años o más de todas las nacionalidades. La Asociación de Abogados de Inmigración AILA, ha recibido información de varias fuentes confiables al respecto. Esto es lo que sabemos: Los niños detenidos y posteriormente liberados recibirán una carta de "amenaza" de ICE, amenazando con detención indefinida y transferencia inmediata a ICE al alcanzar la mayoría de edad si no renuncian a la jurisdicción bajo la TVPRA y retiran las solicitudes de alivio/defensas a la deportación, incluyendo la retirada de su solicitud de admisión ante el juez y la Corte de inmigración. Se ofrecerá a los niños $2,500 para regresar a sus países de origen. Si los niños no cumplen con la "oferta", la carta indica que sus padres/familiares que viven en los EE. UU. serán arrestados. Estamos informándoles de este plan y de su derecho a no firmar nada sin consultar primero a su abogado. Si usted es un menor de 18 años y necesita consejo legal, contacte a un abogado de inmigración. Si recibe tal carta, tome nota de la forma en que se entregó esta carta de ICE (¿Estaba presente el abogado y pudo asesorar? ¿El joven pudo hacer preguntas? etc.), evidencia de coacción o intimidación, elementos de miedo subyacente relacionados con la solicitud de alivio/defensa del niño. Estas declaraciones pueden ayudar a los litigantes a retar las acciones de ICE.
