Real Estate Law 101: Property Inspection Fee - A charge imposed by a mortgage servicer for a cursory inspection (often just a drive-by) to determine the physical condition or occupancy status of mortgaged property. This fee is often unreasonably high and an unreasonable number of inspections are often made, especially if the homeowner has defaulted on mortgage payments. Partition Focus Friday: What happens if one owner wants to keep the property? The best option would be a pre-suit mediation. A pre-suit mediation is a process for resolving the case through a buyout before the partition lawsuit is filed with the court. Once a partition lawsuit is filed, a buyout may be possible by post-suit mediation, judicial order, or by purchasing the property from the Special Magistrate. In a partition lawsuit involving heirs, the Uniform Partition of Heirs Property Act contains provisions on how one co-owner can legally buy out the other co-owners.

Real Estate Law 101: Personal Property - All property not classified as real property, including tangible items, such as cars and jewelry, and intangible property, such as stocks and pensions. In Florida, real property consists of land and any permanent structures or fixtures attached to it, whereas personal property refers to movable belongings that are not permanently affixed. Florida law carefully regulates the relationship between personal property and real estate in three key areas: property taxation, real estate transactions, and tenant protections.
