🚨 Not every custody dispute is a legal emergency.
After nearly 30 years practicing family law, one of the most common misconceptions I see is parents believing they can obtain emergency custody simply because they disagree with the other parent's decisions or because a child is upset after a visit.
California courts generally reserve emergency custody orders for situations involving immediate harm to a child or an immediate risk that the child will be removed from California.
Judges often proceed "out of an abundance of caution" when serious allegations are made, but courts still want evidence, corroboration, and credible information before making significant custody changes.
