I’ve had many people reach out to me with questions about the new denaturalization regulations. I hope this overview is helpful.

The extraordinary step of stripping naturalized Americans of their citizenship used to be reserved for individuals who turned out to be war criminals, genocide perpetrators, threats to national security, violent felons or, during the Cold War, communists.

There is growing concern about individuals being detained by ICE at their homes or workplaces.
Under the Laken Riley Act, noncitizens who are charged with or arrested for theft-related offenses, including burglary, larceny, or shoplifting, can now be detained without bond, even if there is no conviction! This law applies broadly and can impact individuals with certain forms of legal status, such as DACA or TPS. Even mere allegations or charges, without a conviction, are enough to trigger mandatory ICE detention.
For lawful permanent residents (green card holders), separate rules apply under the Immigration and Nationality Act. Two or more convictions for crimes involving moral turpitude, such as theft, make a person deportable under INA 237(a)(2)(A)(ii). Even a single theft conviction can make someone deportable if it is considered an aggravated felony (a theft offense with a sentence of one year or more) or if it occurred within five years of admission and is punishable by at least one year in jail.
If you or someone you know has theft-related charges or convictions, be aware of the heightened risks under these laws.

USCIS has reinstated its authority under INA §335(a) to conduct “neighborhood investigations” for naturalization applicants. This means officers may visit an applicant’s home, workplace, or community to verify eligibility and good moral character. While these investigations can also be waived, applicants should be prepared. Submitting strong testimonial letters from neighbors, employers, and colleagues can make a big difference in your naturalization case.

On August 15, 2025, USCIS released a new policy memorandum restoring a rigorous, holistic standard for evaluating good moral character (GMC) in naturalization cases.
This means officers will now consider the totality of your circumstances, not just the absence of a criminal record!

Look what just came in the mail today!
This client’s journey is truly inspiring.
She was only 10 years old when an Immigration Judge ordered her removed from the U.S. after failing to appear at her hearing. Despite that, she grew up here, attended a prestigious university, earned her bachelor’s degree, and built a successful career.
She later married a U.S. citizen, and he tried to petition for her, but the case was denied because of her old deportation order. That’s when the couple came to me.
I was able to reopen her old court case and have it terminated. We then filed directly with USCIS, and today she received her green card and is officially a Lawful Permanent Resident of the United States.
Stories like this remind us that with the right legal strategy, persistence, and hope, new chapters are always possible.

Join Our Team!
We’re looking for a Senior Immigration Paralegal with 3+ years of EOIR experience. Must be bilingual (English/Spanish). Full-time, in-office (Riverside, CA) Make an impact, apply today!

Lately, I’ve seen a troubling number of denied adjustment cases previously handled by other attorneys. Many were denied due to critical omissions, missing documents, incorrect information, or failure to file necessary waivers.

In one recent case, the prior attorney submitted an AOS application using someone else’s personal information. In another, they neglected to file required waivers despite the client having prior apprehensions and a removal order, a mistake that made approval impossible.

Too often, these oversights force clients to refile and repay filing fees, delaying their path to lawful status.

If your immigration history is complex, get a second opinion before filing. It may save you significant time, money, and stress!

If you weren’t born in the U.S. and became a citizen through naturalization, you can lose your citizenship if you’re convicted of fraud against an individual or government.

Denaturalization is a tactic heavily used during the McCarthy era and one that was expanded during the Obama administration and grew further during President Trump's first term. It's a tool usually used in only the most serious and rare of cases: dealing with N***s or war criminals.
