Hi folks, did you know that in Modesto, Stockton, Sacramento, and Turlock, if you are a homeowner or an owner of real property, you can be held liable if someone injures themselves on the sidewalk that is in front of, abutting, or adjacent to your property? If you didn't, now you know! The City is NOT responsible. You are! This varies from city to city, but a majority of cities in California makes it your responsibility to fix that dangerous sidewalk. Hi folks, happy Friday! Just wanted to let you folks know that if you are in a car accident, you need to at least report it to the police. I know you want to be nice. I know you just want to get out of there. I know you just want to go home. But, it is extremely important you report it or you could be left paying your own medical bills!!!! The reason is that in some instances, the other person that caused the accident may not have valid insurance. What I mean is that they may show you an insurance card, you take a picture or you write the information down, then later on, when you go to make a claim against their insurance, it gets denied because it is not a valid insurance. Meaning, this person didn't pay their bill on time, they made up the card, it's someone else's insurance, etc...whatever the reason, it is simply not valid! Now you are stuck with injuries, medical bills, car repairs, towing, etc... Who pays for that? You will be! Unfortunately, I've seen this more times than I can count. However, if you report the accident to the police, your own insurance may be able to help! After all, why pay for years of insurance if you can't use it when you need it the most! But, you must comply with certain rules before your insurance will take effect! Here's my previous article.

I just want to remind everybody that there is no law about having to give a recorded statement to the other party's insurance company. After an accident, things happen very fast and one of the first things that happens is a recorded statement. This can happen in any case, whether it is an auto accident, slip and fall, motorcycle accident, bicycle accident, etc... But please understand that you are not doing yourself any favors by agreeing to a recorded statement. Here's my previous article on this subject.

Hi folks, I just want to take a moment to inform all our bicyclists out there about how to properly and lawfully ride on the road. Under California Law (and in most municipalities), when you ride your bike, you cannot ride your bike on the sidewalk. This is a very common misconception. Sidewalks are meant for pedestrians, not bicyclists. You must ride on the street and you must ride in the same direction as traffic. If you use the crosswalk to cross, you must get off your bike and walk your bike. Crosswalks, like sidewalks, are for pedestrians. More to come later when I get more time.
