Is it smart to cooperate with the two breathalyzers you will have to take, when you get stopped for suspected DUI in Michigan? Generally, yes, but occasionally no

The roadside breathalyzer, or “PBT“ is typically not admissible in court, due to its high error rate. It is a civil infraction that will result in fines, but there is no license penalty, and it will not be reported on your Driving Record.

However, this is not true for people with commercial drivers licenses (CDL).It is a misdemeanor for those folks, even if the PBT shows a blood alcohol of less than the legal limit

The breathalyzer in the police station is a completely different story. Whether you know it or not, you have *already consented* to that breath, test, and your failure to actually submit will result in the revocation of your license, unless you quickly request a hearing on the subject from the Secretary of State‘s office. If you were in that situation, call me immediately.
