Premises cases in Virginia are won or lost in the ten minutes after the fall, usually by someone who has no idea that is what is happening.
If you fall in a Richmond store, restaurant or parking lot:
• Photograph the hazard before it is cleaned up. Within an hour it will be mopped, coned or fixed — and that it was fixed is not proof it was dangerous
• Photograph your own shoes and the wider scene. The other side will ask about both
• Get the names of anyone who saw it, including employees. Staff turn over
• Ask for the incident report, and ask for a copy
• Say what happened. Do not editorialize
• Ask in writing that surveillance footage be preserved. It is usually overwritten within days
That point about wording is not a technicality. Virginia is a contributory negligence state — if a jury decides you were even slightly at fault in causing your own fall, you recover nothing at all. A generous, self-blaming sentence said to a manager while you are embarrassed and in pain has ended real cases.
The case turns on whether the owner knew, or should have known. That gets proven with maintenance logs, prior incident reports and inspection records — documents you can ask for, and that get harder to obtain the longer you wait.
We've explained which records matter and how to request them:
