A federal judge has struck down the Trump administration's limits on asylum and immigration applications.

One of the policies the judge invalidated had halted all legal immigration applications filed by citizens of 39 countries listed on President Trump’s so-called “travel ban” list, which restricts travel from countries whose nationals the administration says are too difficult to screen properly.

The May 2026 USCIS issued a Policy Memo directs officers to treat Adjustment of Status (Form I-485) as a discretionary “extraordinary” relief rather than an automatic right.

It emphasizes that applicants should ideally use consular processing outside the United States. The policy shift primarily functions by instructing adjudicators to execute a stricter, case-by-case evaluation of both positive and negative factors in an applicant’s history.Key Details & ImplicationsNo Statutory Ban: The memo does not change the underlying eligibility laws, ban Form I-485 filings, or halt current processing.Discretionary Weight: Officers are required to weigh the totality of circumstances. Negative factors (e.g., unauthorized employment, immigration status violations, or inconsistent conduct) may result in a discretionary denial, requiring applicants to demonstrate why they merit a favorable exercise of discretion.

USCIS announced a new policy memo today that will grant ‘Adjustment of Status’ only in extraordinary circumstances.

The new policy states that aliens seeking adjustment of status must do so through consular processing at a U.S. consulate abroad. Officers are directed to consider all relevant factors and information on a case-by-case basis when determining whether an alien warrants this extraordinary form of relief.

Further stating that “Nonimmigrants, like students, temporary workers, or people on tourist visas, come to the U.S. for a short time and for a specific purpose. Our system is designed for them to leave when their visit is over. Their visit should not function as the first step in the Green Card process. Following the law allows the majority of these cases to be handled by the State Department at U.S. consular offices abroad and frees up limited USCIS resources to focus on processing other cases within its purview, including visas for victims of violent crime and human trafficking, naturalization applications, and other priorities. The law was written this way for a reason, and despite the fact that it has been ignored for years, following it will help make our system fairer and more efficient.”
