An exciting new Biden program will give undocumented immigrants who have been in the U.S. since June 17, 2014, and who are married to U.S. citizens as of June 17, 2024 or earlier, the chance to get green cards without leaving the U.S. This includes immigrants who entered the U.S. illegally.
This is obviously fantastic news for a lot of American families.
We’ll update this page once more information is released, but here are a few things to keep in mind:
1. We still don’t have a lot of details about the program. It probably won’t be available until August. Wait until the program is available before hiring legal assistance.
2. Be careful about who you have help you with this process. Some “notarios” may offer their services with this before the program details are finalized—some of them may take your money and disappear. Choosing the wrong person to assist you with this may cause you major problems, including the possibility of deportation. There are qualified immigration attorneys in the Idaho Falls area. 3. You will likely need to prove you’ve been in the U.S. the last ten years. Things like school records, paystubs, etc. will be helpful to show your history in the U.S. You can start collecting those now.
4. You’ll also need to provide evidence of the marriage. Proof you’ve been living with your spouse, you share finances, and you share a life together. Lease agreements, joint bank statements, joint tax returns, and pictures are all helpful.
5. Filing fees will likely be expensive. Start saving now.
6. If Donald Trump becomes president, this program will most certainly be closed. Additionally, court cases could potentially stop or slow it. It has the potential to be a huge help to a lot of American families, but like anything in immigration, success is not guaranteed.
If you entered the U.S. illegally, you’ve been in the U.S. for at least ten years, and you’re married to a U.S. citizen, keep a close eye on this program. It may be the best way for you to get a green card.

USCIS is planning on sharply increasing immigration fees. The proposed rules will increase the cost of filing many forms by 20% and some common forms will more than double in price. The changes aren't guaranteed to take place, but it's likely that applying for an immigration status will become more expensive within the next few months. If you're thinking of filing, now's the time to do it--before prices go up.

It's time to start the process for seasonal visas for next summer. H-2B visas are great for companies that handle landscaping, forestry, construction, tourist industry, and other non-agricultural seasonal jobs. Congress has been slow to move on much-needed immigration reform, but at least they're considering some right now--specifically for year-round farm workers, such as those working on dairy farms. Obviously that would be a big deal for many immigrants in Idaho.

Two Senators are closer then ever before on an immigration-related bill that would provide a much-needed workforce for agriculture. But can they get the Farm Bureau on board the final sticking point?

Getting married this summer? Congratulations! And for those who may be eligible for a green card after marriage to a U.S. citizen or permanent resident, two things to keep in mind:

1. Collect evidence of the wedding! Even if it's a simple courthouse wedding, make sure to take pictures. If you rented space, bought a wedding cake, or bought a dress, keep the receipts. They can help with your green card application.

2. Watch out for international travel! Traveling internationally before or after your wedding can cause various problems--it might delay your case, it might lead to you not being able to reenter the U.S. after travel, it might even lead to a ban. This includes cruises. Speak to an immigration attorney before you make plans for international travel.

There are a lot of other factors that can affect your green card case that you should be aware of prior to the wedding--things like the impact of the J-1 2-year rule, prior divorces and annulments, children who may be able to get a green card too depending on the situation, whether it's best to get married abroad, whether a fiance visa is a good option, and if an extreme hardship waiver might be necessary.

If you're eligible for a green card or citizenship, now's a great time to apply. Why?
1. It's cheaper. President Trump tried to raise filing fees significantly. He failed. Filing fees have stayed the same for several years; however, with inflation, rising costs, and possibly a new president in a couple of years, there's a good chance the process will be a lot more expensive three or four years from now.
2. It's simpler right now. President Trump changed the citizenship test to make it harder (it's back to the normal test now) and made the green card process much more difficult with his public charge form (which President Biden got rid of). If Trump becomes president again, expect the process to become more difficult too.

If you're eligible for citizenship or a green card, don't procrastinate. Get it taken care of while it's easier to do.
