I’m pleased to be participating in the University of Pennsylvania Law School’s 2026 Symposium, “The Declaration at 250,” co-sponsored by the National Constitution Center on Friday, February 27, 2026.
I’ll join an outstanding panel — “On Liberty: Legislative Power of the Purse” — examining how the Declaration’s grievances over executive usurpation of legislative authority continue to shape modern separation-of-powers disputes over taxation, spending, and impoundment. Freezing more federal funds in one day than all presidents in American history combined, the Trump Administration has rekindled a controversy more divisive than that experienced in Nixon's time. For all the lip service lawyers give to the "access to justice gap," we have taken little action to address what we all seem to regard as a crisis.

Rather than close the gap, we maintain "ethical rules" designed to protect our turf. Under the guise of protecting the public, we insist that every legal problem be addressed by fully-licensed lawyers and make it a crime for non-lawyers to provide more limited legal service affordably. In the latest issue of the Maryland Bar Journal, we seek solutions--not more "studies."

Does our monopoly on the delivery of legal services really protect those who cannot afford us anyway?

Q. Every week, consumers and business owners call me with cases that aren't large enough to justify my fees. I hate turning them away. But what's the alternative?
