Estate Planning 101: Don’t Get Caught in an Abatement Trap

Good estate planning is a bit like juggling sharp axes. A moment of inattention can spell disaster for you, your clients, and their beneficiaries. One such axe, commonly overlooked by new estate planners, is abatement: the order in which the decedent’s property is used to pay for the decedent’s debts and costs of administration based on the class of gift. The statutory framework for abatement is found at Probate Code sections 21400–21406. However, the statutory rules may result in unintended consequences, requiring the planner to modify the rules in the will or trust. (Prob. Code, § 21400, instrument may provide for abatement.)
