"If a computer was driving, who's even left to sue?" That's the first thing people say when a robotaxi is the one that hit them.

A few days after the crash, you're staring at a blank email to the rideshare company's claims department, unsure what to even ask for.

That email, or a proper version of it, is usually the first real document in a case like this. A preservation letter should generally spell out what needs to be held: the event data recorder, sensor data, and software version history, and it typically goes out to the manufacturer, the software developer, the fleet operator, and the insurer.

Rolling camera feeds are often overwritten within minutes or hours. The event recorder holds on longer but can still get wiped by a software update or repair. In California, Wisconsin, and Nebraska, once a lawsuit is reasonably anticipated, whoever controls that data has a legal duty to preserve it, and losing it afterward can mean sanctions against them.

Saturday morning rides through Madison don't usually end with you standing in the driveway deciding whether the bike is worth fixing.

That decision matters. More than it looks. Once the frame gets straightened and the cracked helmet gets tossed, nobody can go back and measure what actually happened. Keeping the motorcycle or bicycle in its post-crash condition is typically crucial, since it lets an accident reconstruction expert study the crush pattern and pull data off any onboard computer before that evidence is gone.

The gear matters just as much. A cracked helmet, a torn jacket, a bent kickstand, or a damaged headlight can directly rebut an insurer's claim that you weren't visible, weren't going the speed you said, or weren't wearing what you should've been.

Wide shots of the scene, the skid marks, and both vehicles often do the same work for the story around it.
