As of August 13, 2026, The Department of Homeland Security is no longer honoring most ADVANCE PAROLE documents.

If you plan to travel using an I-131 Advance Parole approval, please seek legal counsel.

If you are already outside United States on Advance Parole and left before or on August 13, 2026, you are likely safe to return to the United States. See Matter of Delcarmen-Lara, 29 I&N Dec. 830 (BIA 2026).

On May 22, 2026, U.S. Citizenship and Immigration Services (USCIS) issued Policy Memorandum PM-602-0199 and an accompanying press release stating that adjustment of status (AOS) is an “extraordinary” form of relief and that foreign nationals should generally pursue immigrant visas through consular processing abroad rather than seek permanent residence from within the United States.
