We are pleased to share what is believed to be the first employee misclassification ruling involving remote we**am models in the country. The Court’s thoughtful analysis of the ABC test, including recent New Jersey labor guidance, establishes liability on the state law claims. The case now moves to damages, including unpaid wages for “free chat” time and recovery of 100% of tips for more than 400 Class Members, after Defendants allegedly kept 65% of tips dating back to 2019.
