Our firm reached a confidential settlement in a pharmaceutical malpractice case against a major pharmacy chain recently. The case arose out of the pharmacy’s complete failure to comply with CA law in dispensing a medication that caused our client to suffer from a life threatening condition. The mediator, a retired federal judge, knows Chuck LiMandri and was very gracious in thanking him for his tireless efforts in defense of religious liberty — not something we hear often from judges. He also referred to Chuck as “one of the few dragon-slayer lawyers” he knows in town. We’ve heard people refer to Chuck as a bulldog, warrior, and even a honey badger, but dragon-slayer is a new first.

Chuck is a great lawyer and an even better man -- and it's an honor and blessing to work with him and the other skilled lawyers at our firm, and to fight for justice on all fronts.

Here’s a snapshot of some of the important and exciting work being done in our Rancho Santa Fe office today (12/9/20):

- Putting the finishing touches on a brief that we’ll file with the U.S. Supreme Court today – seeking emergency injunctive relief on behalf of South Bay United Pentecostal Church

- Deposing officials at the National Abortion Federation on behalf of David Daleiden (Peter Breen of Thomas More Society is handling those in our office)

- Preparing for a hearing on a Motion for Preliminary Injunction tomorrow in Kern County on behalf of Fr. Trevor Burfitt (argument being handled by Chris Ferrara of Thomas More Society)

- Attending a hearing (remotely) in LA Superior Court on behalf of Pastor John MacArthur and Grace Community Church

- Filing a reply brief with the appellate court in our case defending Stephen Brady of Roman Catholic Faithful (who was sued for defamation by Msgr Harrison)

For our personal injury and business litigation matters, we’re:

- Wrapping up a $2 million policy limits settlement we just reached on behalf of a client that was injured in a serious accident

- Preparing for upcoming depositions in two other 7-figure personal injury and medical malpractice cases

- Filing an opposition to an insurance company’s motion to dismiss an insurance class action we filed on behalf of policy holders seeking COVID-19 business interruption coverage

- Prosecuting and defending dozens of other complex business, real estate, and insurance litigation cases

$1.13 Million Update to Welk v. Aviara Victory

LiMandri & Jonna LLP is proud to announce a $1.13 million result in favor of its client, Four Seasons Aviara. Last year, LiMandri & Jonna successfully defended Aviara in a lawsuit brought by Welk Resort Group, obtaining a complete defense verdict after a two week trial. Welk and Aviara are both large timeshare developers. After Welk purchased hundreds of timeshare intervals in the Aviara timeshare resort, Aviara adopted rules to regulate Welk’s actions, leading to the dispute and litigation.

In addition to this first lawsuit, Aviara brought its own lawsuit against Welk, suing Welk for withholding timeshare assessment payments. Following the successful defense verdict in the original lawsuit, and in the face of a new lawsuit, Welk capitulated and paid the $1.13 million in overdue assessments. LiMandri & Jonna then dismissed the lawsuit without prejudice.
