The Lindsay Clancy and Karen Read cases have people asking why prosecutors take such aggressive stances in cases where the evidence of murder is thin.
In this video, Attorney Chris Fiorentino offers an explanation: It's easier to argue the defendant is evil than it is to recognize that the circumstances are complicated and the evidence is ambiguous. It can be better for a prosecutor's office, in the long run (and during election season) to be able to claim that they're the toughest on crime.
Recently, the Plymouth and Norfolk County District Attorney's Offices have shown the folly of that policy by blundering serious cases where innocent people were killed.

Both Plymouth County and Norfolk County have District Attorney's Elections coming up in 2026. Plymouth County DA Tim Cruz is unopposed, but the field is wide open for Norfolk, with 7 candidates running for the Democratic nomination September 1, including some candidates with very thin resumes.

Why is the case against Lindsay Clancy going to trial? Because the Plymouth County District Attorney's Office failed to achieve a reasonable result efficiently.

The evidence plainly shows that Lindsay Clancy had very serious mental health problems - for which she had sought treatment and for which she had been prescribed powerful unpredictable medications intended to alter her mental state - during the time she killed her children and attempted to kill herself.

Here, Massachusetts attorney Chris Fiorentino gives his thoughts on why it didn't.

In short: because the prosecutor's office has lost sight of its duty to achieve justice on behalf of the people. In most cases, including this one, there are a range of reasonable results. Here, negotiated civil commitment rather than criminal prosecution almost certainly could have been achieved without the time, expense, and spectacle of a trial.
