Possession of a Controlled Substance in the State of Washington is now a misdemeanor, instead of a Class C felony. This legislative action follows the Blake decision, which found Washington's PCS law to be unconstitutional (see post below, from February 25, 2021). Prosecutors are "encouraged" to divert such cases for treatment.

Today, the Washington State Supreme Court issued a decision that Washington's "Possession of a Controlled Substance" law is unconstitutional. The basis for the decision is that the law contains no "mens rea" (or mental state) element. The legislature could change the law to add this element, but it is not clear when that would happen. Until that happens, simple Possession of a Controlled Substance in the State of Washington is not a crime. Here is a link to the Court's decision:
