St. Patrick’s Day is next Tuesday, yet I’m seeing posts about St. Patrick’s Day weekend.
Regardless of when you begin celebrating, keep in mind that law enforcement will be on the lookout for people suspected of driving under the influence.
Keep in mind that an Uber is much less expensive than hiring a lawyer and although such a weekend or day, can be good for business, we’d much rather see you get home safe.
Be smart - Make good decisions. Don’t be Kent Dorfman (fat, drunk and stupid [or thin drunk and stupid]).
If you need or want to get drunk, be smart, call an Uber, call a friend, take a taxi, walk if you have to but don’t drive.
If you do, you can always call me from the police station, I’ll be home, sober and pre-gaming St. Joseph’s Day with a zeppole.

The unanimous Declaration of the thirteen united States of America, When in the Course of human events, it becomes necessary for one people to dissolve the political bands which have connected them with another, and to assume among the powers of the earth, the separate and equal station to which the Laws of Nature and of Nature's God entitle them, a decent respect to the opinions of mankind requires that they should declare the causes which impel them to the separation.

We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness.--That to secure these rights, Governments are instituted among Men, deriving their just powers from the consent of the governed, --That whenever any Form of Government becomes destructive of these ends, it is the Right of the People to alter or to abolish it, and to institute new Government, laying its foundation on such principles and organizing its powers in such form, as to them shall seem most likely to effect their Safety and Happiness. He has refused to pass other Laws for the accommodation of large districts of people, unless those people would relinquish the right of Representation in the Legislature, a right inestimable to them and formidable to tyrants only.

He has called together legislative bodies at places unusual, uncomfortable, and distant from the depository of their public Records, for the sole purpose of fatiguing them into compliance with his measures.

He has dissolved Representative Houses repeatedly, for opposing with manly firmness his invasions on the rights of the people.

Since last September the Town of Burrillville has been defending a law suit - two suits actually, brought in an effort to obtain a preliminary injunction to stop the installation of an artificial turf field at the high school.
As Solicitor I was tasked with defending against those suits and as hearings approached, I was scheduled to start a trial on a capital case. Not wanting to delay the litigation, I recommended to the Town that we bring on Attorney Anthony DeSisto (Tony) since I was unavailable to start the hearings as scheduled.
Tony stepped in without a moments hesitation and was ready to proceed on the same day that I was starting my other trial. Amy Veri, Assistant Solicitor also quickly got up to speed on the case and was prepared to sit as co-counsel with Tony.
For other reasons, the Burrillville trial/hearing was postponed and continued to another date. This gave me the opportunity to jump back in to the case and over a period of three weeks Tony and I defended the Town against Plaintiff’s lawsuits.
We had the good fortune of engaging knowledgeable experts from TRC, namely, Liz Denly and Karen Vetrano who were able to convince the Court that the Plaintiff’s claims of harm were speculative at best.
Testimony ended in December. Briefs were filed in January.
Today we received the Court’s decision and Plaintiff’s request for a preliminary injunction was DENIED.
It’s a win for the Town, and a win for Tony and I secondarily…but still, a win of which we can be proud.
I want to thank the Town for providing us the resources to defend these suits.
I want to thank Amy for stepping in when needed and most importantly, I want to thank Tony - one of my oldest and dearest friends to boot - for stepping in and leading the charge on this matter when I became unavailable - and when that availability changed - he remained as resilient and persistent in defending the Town in these lawsuits.
After 40 plus years, I finally got to try a case with Tony. It was an absolute pleasure to work so closely and so hard with my friend.
We put in many hours on this matter and it’s a pleasure to say that we were successful. Tony, thank you. Let’s do it again real soon )).

Yesterday, October 10, I “celebrated” (and by celebrated I mean finishing up a 2 1/2 day bail hearing on a murder case, followed that up with arguing motions on another and managing to leave the office by 8:00 PM), the 40th anniversary of my swearing in to the RI Bar. There are certain dates you just don’t forget.
I take a second - well, a “few,” to reflect on 40 years of practice. First to remember and thank, not just today but everyday, some of the attorneys I had the opportunity to learn from. My father, the Honorable William A. Dimitri, Jr., my cousin, Anthony T. Jackvony, all the defense lawyers I had the opportunity and pleasure to work with through the years (many still active), and the lawyers from the Attorney General’s office and United States Attorney’s office I have had the pleasure of trying cases with/against. There are far too many to mention on both sides but you know who you are.
This applies to all of the Judges as well. It’s been an honor, your Honors, to appear before and try cases in front of you.
Not to mention the attorneys I have had cases with/against in the civil arena as well.
I’ve had a great time - a “blessed” career.
I had the opportunity to serve as Johnston Municipal Court Judge for 16 years, President of the RI Criminal Defense Lawyer’s Association, Board Member of the RIACLU, assistant and full Solicitor for the Town of Burrillville, Assistant Solicitor for the City of Woonsocket, Legislatjve Counsel at rhe State House, and, I’d like to think, a mentor for the younger attorneys who, over the years that have come to work with and for me.
Spreading my wings, so to speak, I had the pleasure of handling cases in Massachusetts, Maine, New Hampshire, New Jersey, Texas, the First and Seventh Circuit Courts of Appeal.
It’s been one hell of a ride - so far - and yet, while I sometimes think about scaling back, just a bit, maybe to 40-50 hours per week, I don’t really see myself retiring until “they carry me out.”
I’d be remiss if I also didn’t thank all the clients that have entrusted their cases - and in many cases, their freedom, to me over the past 40 years.
So to all the lawyers - Judges, clients, friends and family, thanks for making the “first half” (ahem) a great - fantastic experience.
