Jesse doing his best to combat the illogical position taken by the Court that a qualifying patient under the current RI medical ma*****na laws may not use a doctor's prescription for MM obtained after receiving a citation as an affirmative defense because the patient did not have the prescription when he received the citation. The absurdity of the ruling is that it is predicated on the assumption that doctors are mere rubber stamps for ma*****na use and do not actually prescribe it for legitimate medical purposes - why have the law then Rhode Island? This ruling is akin to saying a person may not use the affirmative defense of insanity because they had not been declared insane by a doctor before they committed whatever crime they are using the defense for - nonsense! Either a person has a condition or doesn't, medical conditions don't just arise out of thin air!
