Quite a week!

On Monday a client’s guilty plea is vacated in federal court “in the interest of justice.” This was the right decision for my client, who suffered years of abuse from an older codefendant.

On Friday, another serious felony charge is dismissed in superior court based on “new evidence,” and the complaining witness’s newfound religious beliefs. I’m sure the video of him threatening to kill my client and his girlfriend had nothing to do with it.

Criminal defense, like baseball, is a game of inches. But this week, it was nice to have two home runs.

Judge Montecalvo is a remarkable lawyer and dedicated public servant. Rhode Island is so fortunate to have her. Congratulations!!!

IMPORTANT NEWS: The Rhode Island Supreme Court has ordered the expungement of ma*****na convictions. This is a major development. The process is going to continue in all state trial courts until well into next year, but there is a mechanism to expedite expungement and seal records. A link to the order can be found here:

Attacks on Judge Ketanji Brown Jackson for defending "criminals" are deeply troubling, and intellectually dishonest. Judge Jackson worked as a federal defender, representing prisoners at Guantanamo and yes, people charged with child po*******hy offenses. She did not do this for pleasure or profit, but because the Constitution guarantees everyone the right to counsel. President John Adams was once a criminal defense attorney. So was Abraham Lincoln.

The Senators who criticize Judge Jackson know this. But they are catering to the ignorant and uneducated among us because they have no valid points to make about her qualifications. Some of these same Senators voted twice to acquit a President who extorted the leader of Ukraine and fostered a rebellion based on lies about a stolen election. Due process is a right that belongs to everyone, not just the wealthy and well connected.

This is not about being "soft on crime." It's about a system where accused parties are entitled to a lawyer, even when they cannot afford one. Defending an accused is one of the noblest callings in the legal profession. What Judge Jackson did as a federal defender deserves praise and admiration, not scorn.

Just my two cents. Let's hope Judge Jackson is quickly confirmed.
