💜 October is Domestic Violence Awareness Month 💜
Did you know that survivors of domestic violence have important rights they can assert during their abusive partner’s criminal case?
⚠️ In New Hampshire, victims are entitled to the following rights under RSA 21-M:8-k:
1️⃣ The right to be reasonably protected from the accused throughout the criminal justice process (II(c));
2️⃣ The right to reasonable and timely notice of all court proceedings, including post-conviction, parole, and probation hearings (II(d));
3️⃣ The right, on the same basis as the accused, to attend trial and all other court proceedings (II(e));
4️⃣ The right to appear and be heard at any disposition, release, plea, sentencing, or parole proceeding (II(p));
5️⃣ The right to confer with the prosecution and be consulted about the case’s disposition, including plea bargaining (II(f));
6️⃣ The right to full and timely restitution or victim compensation for their losses (II(j));
7️⃣ The right to be treated with fairness, dignity, and respect for safety and privacy (II(a));
8️⃣ The right to designate counsel to speak or write on the victim’s behalf when making an impact statement or exercising their rights.
