The horrific cap on damages for injured people in Oregon has finally been ruled unconstitutional in Oregon by the Oregon Supreme Court. Finally Oregonians can be fully compensated by Juries of their peers awarding what’s reasonable.

FYI from the State of Oregon relating to all insurance policies today, which may give struggling people a little leeway...from your friendly injury lawyer FB friend...obviously, always safest to pay if you can

“Oregon Dept of Financial Regulation re: insurance policies, Important announcement - EFFECTIVE IMMEDIATELY :

Insurance companies must take steps immediately to do the following until the order is no longer in effect:
Institute a grace period for premium payments on all insurance policies issued in the state
Suspend all cancellations and nonrenewals for active insurance policies
Extend all deadlines for consumers to report claims and communicate about claims
Provide consumers the ability to make premium payments and report claims while maintaining safe social distancing standards
The order is effective immediately, and will be in force through at least April 23. If necessary, the department may extend the duration of this temporary order.”

Pleased to announce a Binding Arbitration result on an Under-Insured Motorist case of slightly more than $300,000.00 against GEICO...more than enough to clear out the $100,000 policy limits on this case that they only offered $10K on and were clearly trying to earn interest on by keeping the $100k in their accounts for close to a year (“playing the float”—see Warren Buffet youtube videos...he’s the owner of GEICO)...nice vindication for my client who’s been through hell...

Sadly, Oregon’s cap on non-economic “pain & suffering” damages would reduce the award to five hundred thousand. Oregon’s idea of injury values is obviously out of step with the rest of country. Ask your State Legislators to remove the damage cap, thanks.
