Good news, folks, with the passage of Senate Bill 397 this year, Expungement eligibility will be greatly expanded for many people. The law takes effect on January 1, 2022. Also, there will no longer be a $281 court filing fee! Here's a reminder: in Oregon, a convicted felon does not lose their right to vote. ORS 137.275.
It is only while incarcerated that a person convicted of a felony is not allowed to vote. ORS 137.281.
No magic extra process is required in order for a person with a felony conviction to register to vote.

So this was a fun case. My client was an interesting fellow. He was a little rough around the edges, but he and I usually got along quite well. It took forever (months and months really) to get this case out to trial. When it finally did go to trial we beat (hehe) the Public Indecency charge, but lost on the Disorderly Conduct charge. It turns out, the Court of Appeals agreed that the Defense Motion for Judgment of Acquittal on the Disorderly Conduct charge should have been granted.
Conviction reversed.

I'm going to post a series of cases in which I've had a client's conviction reversed on appeal. These types of reversals from the Court of Appeals can happen for a number of reasons. In this case, State v. Norton, the Appeals Court said the Trial Court committed legal error by denying our Defense Motion to Suppress the evidence based on an unlawful seizure and search.
